These Terms of Service ("Terms") and Privacy Policy ("Policy") govern your access to and use of EXSPATIALIS, a cloud-based geographic information system for Mars surface research and planning, operated during public beta. By creating an account or using the service you agree to be bound by these Terms. If you do not agree, do not use the service.
EXSPATIALIS intellectual property. All software, design systems, data pipelines, analysis algorithms, visualisation layers, and documentation comprising the EXSPATIALIS platform are the exclusive intellectual property of EXSPATIALIS and its licensors. Third-party scientific data. The underlying planetary datasets (MOLA, HiRISE, THEMIS, GRS, SHARAD, and others) are products of NASA, ESA, and associated research institutions, made available under their respective open-data licences. EXSPATIALIS processes, fuses, and hosts these datasets to provide the service but does not assert copyright over the raw data itself.
User content. You retain full ownership of annotations, markers, polylines, project files, and any data you create or upload ("User Content"). By using the service you grant EXSPATIALIS a limited, non-exclusive, royalty-free licence to store, process, and display your User Content solely for the purpose of delivering the service to you.
Restrictions. You may not copy, reproduce, distribute, reverse-engineer, decompile, or create derivative works from any part of the EXSPATIALIS software platform without prior written consent. Exported GeoJSON, KML, and mission data files generated from your own projects are yours to use freely.
EXSPATIALIS provides a cloud-hosted, browser-based geographic information system for research, education, engineering, and planning activities relating to the Martian surface. The platform fuses scientific datasets from multiple missions to deliver elevation models, thematic overlays, coordinate samplers, sector analysis tools, and mission planning utilities.
The service is currently offered in public beta. Features, pricing, data accuracy, and platform availability may change without notice. The platform is not intended for life-safety, spacecraft navigation, or any mission-critical use without independent verification.
You must be 13 years of age or older to create an account. By registering you represent that all information you provide is accurate and that you will keep it current. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
EXSPATIALIS reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are inactive for more than 24 consecutive months.
You agree not to: (a) use the service for any unlawful purpose; (b) upload or transmit malicious code, spam, or content that infringes the rights of third parties; (c) attempt to gain unauthorised access to any part of the platform or its infrastructure; (d) scrape, crawl, or systematically download data layers or tile caches without written permission; (e) use the service to train machine-learning models for commercial purposes without a separate data licence agreement; or (f) misrepresent your identity or affiliation.
What we collect. We collect your email address, name (optional), country, discipline, organisation (optional), and referral source at sign-up. We also collect usage telemetry (page views, feature interactions, error logs) and technical metadata (IP address, browser type, device) necessary to operate and improve the service.
How we use it. Account data is used to authenticate you, deliver the service, and communicate with you about the platform. Usage telemetry is used for product analytics and infrastructure optimisation. We do not sell, rent, or share your personal data with third parties for advertising purposes.
Third-party processors. We use the following sub-processors: Google Cloud Platform (hosting and storage, us-central1), Stripe (payment processing for card transactions), BTCPay Server (Bitcoin payment processing), and Postmark or Resend (transactional email). Each processor is bound by appropriate data processing agreements.
Your rights. You may export your data at any time, including profile details, markers, polylines and polygons, drop targets, AI-assisted location analysis results, and project files, from Account → Data & Privacy or from the relevant tool panel. You may request deletion of your account and all associated data from the same page, or by emailing us. Deletion is permanent and irreversible.
Cookies. We use session cookies for authentication and local storage for application state (e.g. last-used project, layer preferences). We do not use third-party tracking cookies.
EXSPATIALIS runs on Google Cloud Platform infrastructure in the us-central1 region. All data in transit is encrypted via TLS 1.3 or later. Project data and user content at rest is encrypted using Google-managed keys (AES-256). We maintain daily backups with a 30-day retention window.
Uptime is provided on a best-effort basis during beta. We target >99% monthly availability but make no SLA guarantee during the beta period. Scheduled maintenance will be announced via in-app notification where possible.
Paid tiers (Pioneer, Settler, Colonist) are available as monthly or annual subscriptions. Prices are displayed in USD. Annual subscribers are billed once per year; monthly subscribers are billed each calendar month. All prices marked "* beta pricing" are early-access rates that may increase at general availability.
Card payments are processed by Stripe. Your card details are transmitted directly to Stripe and are never stored on EXSPATIALIS servers. By providing card details you authorise Stripe to charge you on the applicable billing cycle.
Bitcoin payments are processed via BTCPay Server. Payment can be made on-chain or via Lightning Network. Bitcoin subscribers receive an automatic 10% discount. The USD equivalent is locked at the moment the invoice is generated; invoices expire after 15 minutes. Once an invoice is settled, the payment is final and non-reversible.
EXSPATIALIS is operated from Australia. Depending on your location and applicable law, your purchase may be subject to VAT, GST, sales tax, or similar levies. Where we are required to collect such taxes, they will be calculated and added at checkout; where we are not, you remain responsible for any taxes applicable in your own jurisdiction.
You may cancel your subscription at any time from Account → Billing. Cancellation takes effect at the end of the current billing period; you retain access until then. We do not offer prorated refunds for the unused portion of a billing period during beta. Exceptions may be made at our sole discretion for billing errors or service outages exceeding 72 hours.
The service is provided "as is" during the public beta period. Features may be incomplete, temporarily unavailable, or subject to breaking changes. Scientific data layers are sourced from public NASA / ESA datasets and are provided for research and planning purposes only. EXSPATIALIS makes no representations as to the accuracy, completeness, or fitness of any data layer for a particular purpose. Do not rely solely on EXSPATIALIS data for mission-critical or life-safety decisions.
To the maximum extent permitted by applicable law, EXSPATIALIS and its directors, officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the service, even if advised of the possibility of such damages. Our total aggregate liability for any claim shall not exceed the amount you paid to EXSPATIALIS in the 12 months preceding the claim.
EXSPATIALIS is operated from Australia and is not a U.S. service provider, so the U.S. Digital Millennium Copyright Act does not directly apply to us. We nonetheless take copyright seriously and will respond to good-faith infringement notices. If you believe that content available through EXSPATIALIS infringes your copyright, you may submit a notification to the address below. Your notification should include: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the allegedly infringing material and its location on our service; (c) your contact information; (d) a statement of good-faith belief that the use is not authorised; and (e) a statement, made under penalty of perjury, that the information provided is accurate.

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which EXSPATIALIS is incorporated, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be resolved by binding arbitration, except where prohibited by applicable consumer protection law.
We may update these Terms from time to time. Material changes will be communicated via in-app notification and/or email at least 14 days before they take effect. Your continued use of the service after the effective date constitutes acceptance of the updated Terms.
